| Patna, (Bihar Times): In a  significant judgement the Patna  high court on Friday sets aside the results of preliminary tests for the 48th  to 52nd combined competitive examination conducted by Bihar Public Service  Commission (BPSC). Incidentally, the BPSC was scheduled to hold the main  examinations from February 2. A single bench of Justice Navin Sinha while setting aside  the results on a bunch of petitions filed by unsuccessful candidates alleging  irregularities in holding the examination directed BPSC to conduct a fresh the  preliminary test and work out modalities for it. The court holds that the entire preliminary test process  conducted in persuance of advertisement number 4 of 2007 is vitiated. The  Commission is directed to hold afresh the preliminary test in accordance with  the law, the ruling said. The court rejected Advocate General P K Sahi's contention  that the petitions be rejected as only a miniscule number of unsuccesful  candidates of the over 1.76 lakh who appeared for the test had approached the  court seeking annulment of the result. The ruling said that: “Even if the rights of a person is  violated it is unacceptable in a democratic set up. We are here to protect the  right of that single person.”. The BPSC had conducted the preliminary tests on May 25 last  year at 530 centres across the state and 19,318 candidates were declared  successful on September 19. About 150 unsuccessful candidates had moved the  court alleging anomalies in the question paper. They alleged that many  questions were faulty, while some model answers were also wrong. Some others  had charged that the number of questions also varied indicating that the test  was conducted in a discriminatory manner.
