DC Bills case to be re-heard by High Court

Patna,(BiharTimes): The PIL filed in the Patna High Court seeking to order a CBI probe into the allegations levelled in connection with the Comptroller and Auditor General report would now be re-heard by Chief Justice Rekha M Doshit and Justice S K Katriyar "in due course of time." The judges made the observations while disposing of an Interlocutory petition filed by state government urging the bench to modify its earlier order summoning the CBI Director and Joint Director in the case on July 26, 2010.


It needs to be recalled that the CAG report has highlighted financial lapses of Rs 11,412 crore in execution of development and welfare schemes between 2002-03 and 2007-08.

The Court stated that with the passage of several months, its previous order had lost its significance and the matter be heard afresh. The High Court had, on July 23, 2010, stayed the operation of its previous directive to the CBI Director and Joint Director to be present in the court on July 26, 2010 to explain as to whether the case was fit to be probed the agency and reserved its order on the modification petition.

As reported Arvind Kumar Sharma and others had last week filed an interlocutory application in the Court urging it to pronounce its final order reserved on the state government's modification petition on July 23, 2010. They pleaded that the division bench rehear their arguments afresh to which the judges said the initial writ petition for a CBI probe would be listed for hearing in due course.
