Rupam’s lawyer file fresh plea in BJP MLA murder case

 

Patna,(BiharTimes): The lawyer of Rupam Pathak, the prime accused in the BJP MLA Raj Kishore Kesri murder case, on Thursday moved a fresh petition in the court of Chief Judicial Magistrate (CJM), Purnea, D L Prasad, praying for rejecting the closure report filed by the investigating officer (IO) and treat the same as complaint petition.

The fresh plea comes ahead of the hearing on the protest petition filed by Rupam scheduled for March 25.

It needs to be recalled that Rupam had filed a protest petition in the CJM court on September 16, 2010, after she had retracted on the charges of her sexual abuse by Kesri and his aide, Bipin Rai. It was only after the rejection of closure report that Rupam finally stabbed to death the MLA on January 4.

Lawyer Dinesh Kumar said that the fresh petition was necessitated due to some recent developments in the wake of investigation by the CBI and collection of evidence during the search of the house and school of the accused.

According to the media reports the lawyer, in the fresh petition, averred the seizure of at least three diaries of Rupam Pathak containing vivid details of how she was subjected to rape by the two accused, especially the surviving accused Bipin Rai and how the authorities tried to deny justice to her by refusing to take her accusations seriously.

As reported earlier too Rupam is in possession of photographs which prove that the accused Bipin Rai was familiar with the petitioner and was a frequent visitor to her premises.

The petition further said that the closure report is a bundle of lies and its acceptance could result in the miscarriage of justice.
