Another senior retired judge flays Nitish govt, this time on limiting RTI query

 

Patna,(BiharTimes): Another senior retired judge has come down heavily on the Bihar government. Exactly a week after Justice (Retired) Markandey Katju flayed the state government for Press censorship the Retired Chief Justice of Delhi High Court  Ajit Prakash Shah, famous for taking stand against former Chief Justice of Supreme Court K G Balakrishna, criticized the Nitish government for limiting RTI query to one question per application. He said that it was in contravention of the RIT Act and appealed to the state government to drop it.

Justice Shah said a rule can not restrict the application of an Act. A rule is beyond the provision of an Act. “I wish somebody challenge it in court, he told Hindustan Times on Friday.

He said the rule was not fair as it was restricted to not one subject but to one question and that too of maximum 150 words. He also punched holes in the state government’s much-touted Jankari scheme claiming that it has received 1.06 lakh calls. He said now the same rule had restricted each call lasting only one question at a time.

He also said that it was desirable that the government put in place a transparent system for appointment for the most qualified people to run the Information Commission. The government should not reduce the Commission to a post of superannuation rehabilitation centre for bureaucrats having political patronage, who toe the government’s line while in service. 

Justice Shah is in Patna to attend the two-day RTI meet which was inaugurated by the chief minister Nitish Kumar on Friday.
