Bihar government moves SC for transfer of PMC Commissioner


Patna,(BiharTimes): The state government has moved the Supreme Court for the transfer of the Commissioner of Patna Municipal Corporation (PMC), Kuldeep Narayan.

A special leave petition which has been filed in the Supreme Court recently seeks to set aside a Patna High Court order which refrains the state government from transferring him without the High Court’s permission. A number of cases related to the violation of by-laws are pending in the High Court.

A division bench of the High Court comprising Justice Navin Sinha and Jusitce Vikas Jain had, while hearing a PIL related to rampant violations of building by-laws by builders in July, passed the order. “both for the purpose of continuity and answerability” of the PMC.

According to the additional advocate general Shivaji Nath the SLP had been filed to challenge the High Court order on the ground that the transfer of officers was the prerogative of the government and the court must not interfere in it.
It is said that a powerful lobby wants to get rid of the PMC Commissioner. Since they enjoy enormous political clout they have compelled the state government to move the apex court.

Buildings constructed by controversial JD(U) MLA, Anant Singh and Sanjay Singh are under the PMC scanner for rampant violation of building by-laws.
As reported construction has already been stopped in 141 such apartments.
It needs to added that the Patna High Court has also restrained the state government from transferring the registrar of the Co-operative Societies, Hukum Singh Meena.

A division bench of the Patna High Court compising Navin Sinha and Justice Shailesh Kumar Sinha on October 31 asked thestate government not to shift Meena, an IAS officer, until further order.

The court responded to a writ petition filed by one Narendra Mishra in connection with rampant violation of building by-laws. The court has taken serious view of the construction of apartments and non-residential activities on plots ear-marked for co-operative Socieities. It directed the registrar to take stern action against the violators of law.
