Patna,(BiharTimes): The court of Patna Municipal Corporation Commissioner, Kuldip Narayan, on Sunday declared the construction of Hotel Buddha Inn, situated in posh Patliputra Colony, as illegal.

The order said: “The accused party has constructed a structure on plot no. 14/D, S K Puri without getting the registration, NOC or approval of building plan by the PMC. It has also encroached more than the permissible land and has encroached a certain part of road in an unauthorized manner. Violating the terms of lease agreement, it has also constructed a hotel, which is a commercial venture on a residential property.”

This hotel was in the news sometimes back as the then social welfare minister, Parween Amanullah, strongly protested against the encroachment made by it.

The PMC court ordered its officials to resume the plot number 14/D, Shri Krishna Puri along with other constructed or under- construction structure on the plot within 30 days. 

The PMC will also pay back all the instalments for lease paid so far with six per cent interest.

The plot on which the ground plus five floor structure of the hotel has been built belongs to Neelam Singh, wife of ruling Janata Dal (United) MLA from Mokama, Anant Singh. 

The builder of the hotel, Santosh Jha, has informed the court that he was handed over the hotel for management in September 2013.

This was done after the high court’s order (May 10, 2013) to carry out vigilance inquiry against buildings violating building bylaws in Patna.

The Commissioner ordered the hotel management to vacate the building within three weeks. If they fail to do so, they will be held responsible for damages. The PMC will seal the property after 21 days. 

Once the right of the property is resumed, after removing two floors of it, the building will be used by the Patna Regional Development Authority (PRDA).

The court has also ordered for cutting off power supply to the hotel within seven days.

Orders have been issued for disconnection of water supply and drainage and sewerage lines, if any. Patna ADM has been ordered not to register plot number 14/D, S K Puri without PMC Commissioner’s consent.
