Patna HC rejects Renu’s writ petition

 


Patna,(BiharTimes): The Patna High Court on Wednesday rejected the writ petition of rebel JD(U) MLA Renu Kushwaha, challenging a show cause notice issued to her by the Assembly speaker asking her to explain why her membership should not be scrapped for involvement in anti-party activities. 
Dismissing the petition Justice Jyoti Saran said that the prayer was premature. 
Renu moved the Patna high court on Monday challenging the show cause notice which asked her to explain as to why her membership should not be scrapped under the provisions of the Anti-Defection Law for her alleged involvement in anti-party activities. 
Principal Additional Advocate General Lalit Kishore, who represented the Speaker, pleaded before the court that it has no jurisdiction to interfere in the matter or proceedings and referred to Article 212 of the Constitution which says “no court should interfere in the matter before the legislature during the proceeding on the alleged ground of illegality or irregularity.”
Though Renu has softened her stand since then the court ruling was a blow to the rebels in general.
