Patna,(BiharTimes): A division bench of Chief Justice L Narasimha Reddy and Justice Sudhir Singh of Patna High Court on Thursday upheld the May 4, 2015 decision of a single bench of Justice Vijayendra Nath which had quashed the order of state government on reservation to its Scheduled Castes and Scheduled Tribes employees in promotion.

The decision of the single bench was challenged by the state government on May 18 after RJD chief Lalu Prasad had tried to make it an issue for political advantage of his party when he, in a way, questioned the state government’s delay in moving double bench. CM Nitish Kumar was somewhat upset by his statement in this regard.

According to the bench reservation as a policy can not be continued for an indefinite period. Instead it has to be reviewed from time to time.

A petition in this regard was filed by Sushil Kumar Singh and others.

The Principal Additional Advocate General, Lalit Kishore, said that the state government would challenge the high court ruling in Supreme Court.
