Bihar government challenges single bench order on SC, ST quota in promotion


Patna,(BiharTimes): The state government on Monday filed an appeal before a double-bench of Patna high court against the May 4 order of a single bench of Justice V Nath setting aside the provisions for reservation with consequential seniority in promotions to government employees belonging to Scheduled Castes (SC) and Scheduled Tribes (ST).


According to the principal additional advocate general, Bihar, Lalit Kishore Prasad, there are various legal infirmities in the single-bench order. Monday’s move followed RJD chief Lalu Prasad’s statement on Thursday last in which he had urged the state government to move Supreme Court against the high court order.

The following day chief minister Nitish Kumar made clear the stand of the state government on the issue and said that the state government was well aware of the situation created by the ruling.Justice Nath ruling came on the writ petition filed by Sunil Kumar Singh and others who challenged the state government’s resolution of August 21, 2012. The petition alleged flaws in the data on the basis of which the government decided to give reservation in promotions to the Scheduled Castes and Scheduled Tribes employees. The data is not scientific and is vague in nature, the petitioners had claimed.
