Patna HC takes cognizance of Gopalganj ACJM attack case


 

Patna,(BiharTimes): A day after the District and Sessions Judge, Gopalganj, Sunil Dutta Mishra and other senior judges of the district intimated Patna High Court about the alleged assault on the Additional Chief Judicial Magistrate(ACJM) Prabhunath Prasad the latter on Friday took cognisance of the incident

A bench of Acting Chief Justice Iqbal Ahmad Ansari and Justice Chakradhari Sharan Singh of the high court also directed Director General of Police, P K Thakur, and Principal Secretary Home, Amir Subhani, to personally appear in the case on Monday.

The Gopalganj District and Sessions Judge had annexed the copy of the complaint by the ACJM in which he alleged that policemen had misbehaved with him.

The bench treated the letter as a PIL before taking it up for hearing.

Principal Additional Advocate General Lalit Kishore told the high court that the state government has asked Saran Divisional Commissioner to conduct a detailed inquiry into the incident and submit a report in this regard at the earliest.

He said the state government has already received a preliminary inquiry report from the District Magistrate and Superintendent of Police in this connection.

He, however, added that “we also have a CD that shows that the ACJM became aggressive. We will submit it.

The incident allegedly took place on Thursday when police personnel deployed at Maunia Chowk near the court in Gopalganj had stopped ACJM, who reached the place riding pillion on a motor-cycle––as his car developed snag.

As the district administration had barricaded the road to facilitate election of the chairman and vice-chairman of Gopalganj district board the police reportedly asked him to take a circuitous and relatively longer route to the court.

A verbal tiff between the judge and sub-inspector A K Yadav and constables, who were deputed at Maunia Chowk, ensued over allowing him to go to the court premises through the blocked road. The sub-inspector was neither ready to talk to the SDPO nor the SP despite the judge’s request to do so.
He then lost his cool and allegedly slapped the judge. Some constables standing with him supported him.

However, the ACJM was rescued by the timely intervention of some lawyers. He later filed a complaint case itself with Gopalganj Chief Judicial Magistrate, who took cognisance of the matter and issued summons against the policemn involved in the incident.
