Raj Ballabh gets a week time from Supreme Court






Patna,(BiharTimes): A bench of Justice A K Sikri and N V Ramana of the Supreme Court on Tuesday rejected the Bihar government’s plea that rape-accused RJD MLA Raj Ballabh Yadav be taken into custody so that the minor victim of Biharsharif could testify before the trial court.

The apex court directed the trial court in Biharsharif not to record the testimony of the minor rape survivor till October 24 after the state government submitted that she felt threatened by the MLA, who is out on bail.

The bench passed the order after the Bihar government’s counsel Gopal Singh told the apex court that the girl apprehended threat to her life from the Nawada MLA, who is out on bail.

Senior counsel Sidharth Luthra sought more time to file a response on behalf of the accused legislator, and the bench granted one week time to Raj Ballabh to file his response on the state government’s plea for cancellation of his bail.

“Since we are adjourning the matter for 24th October, 2016, the trial court is requested not to proceed with the recording of the deposition of the prosecutrix (the girl) till that day,” the bench said.

On October 7, the apex court had refused to stay the bail granted by Patna High Court to the MLA but issued notice to him seeking his response within a week on the state government’s plea for cancelling his bail.
