Bails in plenty raises several serious question






Patna,(BiharTimes): Shahabuddin, Raj Ballabh Yadav, Manorama Devi, Bindi Yadav and now Rocky Yadav––the last three of the same family––have one thing in common. They were in the news for all the wrong reasons yet got bails from the Patna high court in the last few weeks.

It is not that the courts do not give bails. But since they are all people with right political connections common citizens are a bit upset. "It marks a serious question on toll claim of state government for initiating action against high profile criminals" said RTI activist Shiv Prakash Rai.

"In the case of Rocky Yadav government didn't started speedy trial as earlier promised" he added

"This is a very bad day for Bihar, I appeal to the government to save Bihar from jungle raj," said Shyam Sunder Sachdeva whose son.Aditya Sachdeva was allegedly killed by Rocky Yadav in a road rage case." We have all the evidence but still justice is denied. Money and power have again silenced the truth."he added

In this period the high court gave another ruling, which many in media, opposition parties and business class welcomed; that is it lifted ban on liquor. But once again an overwhelming number of population, who do not want to know the nitty and gritty of the law, were shocked by the court order.

The story is not this much. Take the case of Shahabuddin. He got bails in all the serious cases of crime in the last several years. Here nobody is going to believe BJP leader Sushil Kumar Modi’s claim that this had happened because of the fear of Shahabuddin. If this would have been the case no lawyer of the don’s home-town, Siwan, would have taken up the case. After all he got convicted in a number of cases by the lower court, yet the high court granted bail.

“Instead of doing politics one must once again ponder over the prevailing legal justice system. After all if RJD supremo and former chief minister Lalu Prasad can be convicted and sent to jail several times––though at present he is on bail––why can not the high court be more cautious in giving bails to these lawbreakers,” said a Bihar watcher.

Like in the cases of Shahabuddin and Raj Ballabh the state government may move Supreme Court against Rocky too––if not against his parents.

But how many times this will happen in case of Bihar?

Once again in case of Raj Ballabh getting a week time by Supreme Court Sushil Modi asked why the state government did not engage  renowned lawyer to fight its case, when the rape accused Nawada MLA of RJD sought the services of noted lawyers like Siddharth Luthra and R. Basant?

The moot question is: have not the renowned lawyers lost the case?

No doubt opposition leaders can allege interference in judiciary. But it raises another question: how is it that the lower court continue to convict or deny bails to all these big and powerful politicians while they are getting bails from the higher judiciary. In a couple of cases the convicted politicians got acquitted. For example, Pappu Yadav’s case. The Madhepura MP, who is now close to NDA, was sentenced to rigorous life imprisonment by trial court in 2008 in CPI (M) MLA Ajit Sarkar murder case, but in May 2013 the Patna high court acquiited him.

Legal issues can be debated among legal luminaries. But the real casualty is Nitish image who recently claimed that "there is no place for dons in Bihar". The way dons are coming out of jails have given enough jolts to changed image of Bihar too.
