SC restores ban on sale of gutka, pan masala






Patna,(BiharTimes): Justice Gopal Gowda and Justice Adarsh Kumar Goel of the Supreme Court on Friday restored the ban on sale of gutka and pan masala in Bihar.

The apex court also refused to cancel the orders of the state governments to ban the sale and consumption of pan masala, gutka and chewing tobacco (zarda) under the Regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales).

The court order came on an appeal filed by Central Arecanut Marketing Corporation and others against the notifications of the respective state governments and UTs in this regard.

The Court also direct the secretaries, health  department of all the states and Union Territories, to file their affidavits before the next date of hearing on November 11 on the issue of total compliance of the ban imposed on the manufacturing and sale of gutka and pan masala with tobacco and/or nicotine.

The state government had banned the sale and consumption of gutka and pan masala with chewing tobacco and nicotine, but the concerned firms moved the Patna high court, which annulled the state government’s ban notification.

The state government went into appeal.
