Patna, (BiharTimes): A local Janata Dal (U)   leader,
        Sarim Ali, on Wednesday filed a criminal complaint
        case against   the Magadh Division Commissioner, K P
        Rammaiah, in the court of Chief   Judicial Magistrate
        (CJM), Gaya.
        
        Sarim, former up-pramukh of the   Manpur block filed the
        case under Sections 219, 384 and 120(B) of the   Indian
        Penal Code. He was earlier removed from his post on a
        complaint   lodged by the block pramukh. Rammaiah passed
        the order for  his   removal.
        
        Rammaiah is already engaged in a turf war with the
        Panchayati   Raj department Principal Secretary Pancham
        Lal on the issue of the power to   remove elected
        representatives of the Panchayati Raj system. Only
        last   month the Commissioner removed the Gaya Mayor and
        Chairman of the Zilla   Parishad.
        
        According to the Section 219 of the IPC “whoever being
        a   public servant, corruptly or maliciously makes or
        pronounces in any stage of   a judicial proceeding, any
        report, order, verdict or decision which he knows   to
        be contrary to law, shall be punished with
        imprisonment of either   description for a term which
        may extend to seven years, or with fine or with   both.”
        
        
        The complaint said that complainant was deprived of
        his   basic legal rights and the commissioner passed the
        removal order without   hearing his version.
        
        The CJM B N Lal Srivastava has fixed April 19,   2008,
        as the next date on which the statement of the
        complainant will be   formally recorded by the court.
