Patna HC stays results of 53rd to 55th BPSC final exam

 


Patna,(BiharTimes): The bench of Justice Mihir Kumar Jha of the Patna high court on Friday directed the Bihar Public Service Commission (BPSC) not to publish the results of the 53rd to 55th combined competitive mains examination till further order.

The court passed the order on a petition filed by Binod Kumar Tiwari seeking the quashing of notification for filling up 100 Bihar Accounts Service (BAS) posts on the ground that the commission cannot fill up these posts without issuing any advertisement in this regard.

Both the BPSC and the state government were supposed to file their respective counter affidavits by Friday.

The state government could not file its reply, while the Commission, in its reply, sought some more time and hence, the matter was adjourned till April 2. The examinations were conducted on the basis of an advertisement issued by the BPSC on January 13, 2011, for 14 services, excluding BAS.

The petitioner’s lawyer Gyan Shankar claimed that in the aforesaid combined exam of the BPSC the Commission had not mentioned 100 posts of the Bihar Accounts Servicce in the original advertisement and it was added only at the time of main examination. 

He contended that such subsequent addition of 100 posts of BAS was not permissible and the same was beyond the purview of the advertisements for the 53rd to 55th examination.
